Employees (casual, full time and part-time) are now entitled to 10 days of Paid Family and Domestic Violence Leave, available from their first day of employment and resetting each year on the anniversary of their start date. This comes into effect on:
1 February 2023 for employees of non-small business
employers, defined as employers with 15 or more employees on 1 February 2023.
1 August 2023 for employees of small business employers,
defined as employers with less than 15 employees on 1 February 2023.
This leave balance will not be visible on an employees payslip, and if taken, should not display any differently to if they had worked. The Fair Work Ombudsman has produced an employer’s guide to assist - https://www.fairwork.gov.au/sites/default/files/migration/1414/employer-guide-to-family-and-domestic-violence.pdf
CloudPayroll has created 2 new Standard Pay Elements as follows:
Adding the Entitlement to Employees
CloudPayroll made a decision to not automatically add an entitlement rule to all employees timesheet templates, to not draw attention to this leave type. However, if you choose to add this entitlement to the employees timesheet, please see below:
- Go to People > View People
- Click on the first employee's name
- Go to their Timesheet Template tab.
- Enter 0 in the quantity box
- Select DL-ENT - Paid Family and Domestic Violence Leave (10 days pa) from the drop down box.
- Click +Add
- Finally click Save on the Transaction Entry Screen.
After you have added the entitlement, you need to add a 10 day balance to the employee. To do this:
- Go to People > View People
- Click on the first employee's name
- Go to the Leave tab, and down to Opening Leave Balances
- Click +Add
- Enter the date as the 1st of February 2023 - this is the date the legislation was passed.
- Select the Leave balance name - Domestic Leave
- Enter 10 in the days box
- Lastly, click the tick to save the balance
Note, this is a days balance, and will be recorded on all reports in days, however it will be entered into the payroll as hours.
If you have a large number of employees, please email us at
help@cloudpayroll.com.au for an alternative option to set this up.
Taking leave
Employees do not have visibility to see this leave type through their payslip kiosk, nor do leave approvers through their leave approver access. To ensure this leave is not visible on the payslip, we recommend entering it into the payroll as follows:
Go to Payroll > Enter
Click on the Employee's Name
If the employee has timesheet
template hours, you should not need to adjust them. If not, in the Qty box,
enter the amount to be paid as T1 - Ordinary Time, or
your equivalent and click +Add. (Using the
employee's ordinary time code ensures their payslip will not look any
different to what they would normally receive.)
Enter a second transaction as a negative of the hours leave taken in the Qty box, select DL-ADJ - Paid Family and Domestic Violence Leave Adjustment as the element in the drop down menu and click +Add. This is a leave type only visible to users with Admin access into CloudPayroll and will not be visible through the employees pay slip kiosk.
On the transaction entry screen, check the Days. This will automatically populate (also as a negative to reduce the leave balance). If not, you will need to complete or update this field.
Optional - select the Date.
Optional - enter a Reason.
Lastly, click Save.
An example of an employees timesheet will look as follows.
And the Transaction Entry
Employee's Payslip and Kiosk
The employee's payslip and kiosk will display as follows:
- Will display in days taken, not hours as with other leave types.
- Will not display a balance of Paid Family and Domestic Violence Leave on the employees payslip.
- When this leave is taken, this should NOT show on the employees payslip
- The employees Leave Calendar will not show any leave taken
The employees payslip will look like the following (via the CloudPayroll app).
